IMAGE LICENCE TERMS & CONDITIONS
Will Arden Photography
Last updated: 02/10/2026
These Image Licence Terms & Conditions apply to photographs purchased from the Will Arden Photography Image Library.
By purchasing an image, you are purchasing a licence to use the photograph under the terms set out below. You are not purchasing copyright or ownership of the photograph.
1. Copyright
All photographs made available through the Will Arden Photography Image Library remain the copyright and intellectual property of Will Arden Photography unless expressly stated otherwise in writing.
Copyright is not transferred to the purchaser.
The purchaser receives only the rights expressly granted by the licence purchased.
All rights not expressly granted remain reserved.
2. Standard Image Licence
The Standard Image Licence costs £180 per image unless a different price is expressly stated on the individual product page.
The Standard Image Licence is:
worldwide;
non-exclusive;
valid for five years from the date of purchase; and
limited to one project, publication or release.
The Standard Image Licence is intended for normal editorial, publishing and creative uses.
3. Uses included in the Standard Image Licence
Subject to these Terms & Conditions, the Standard Image Licence permits the purchaser to use the photograph for:
Books and publishing
printed books;
e-books;
book interiors;
book covers;
e-book covers;
magazines;
journals;
magazine and journal covers;
newspapers;
editorial publications; and
other substantially similar publishing uses.
Music
The licence also permits use as artwork for:
albums;
singles;
EPs; and
equivalent musical releases.
This includes the normal digital artwork associated with the licensed release.
Online editorial use
The photograph may also be used:
on an editorial or publishing website;
within an online article or publication;
on the publisher's or creator's website in connection with the licensed project; and
in organic social-media posts promoting the licensed publication or release.
Promotional use
Reasonable promotional use directly connected with the licensed publication, book, magazine, journal or musical release is included.
For example, this may include displaying the image in:
a publisher's website;
an author's website;
organic social media;
a press announcement; or
promotional material directly relating to the licensed publication or release.
The image may not, however, be used as a general advertising image for unrelated products or services.
4. One project or publication
The Standard Image Licence applies to one project, publication or release.
For example, a purchaser may license an image for:
one book;
one edition of a magazine;
one album;
one single;
one specific editorial project.
The same image may not automatically be reused in unrelated publications, projects or releases.
A new project or publication may require a new licence.
Where substantially the same publication is issued in additional formats as part of the same project, such as a printed book and its corresponding e-book, the Standard Licence may cover both.
Please contact Will Arden Photography if you are unsure whether a proposed use constitutes a new project.
5. Licence period
The Standard Image Licence lasts for five years from the date of purchase.
The licence permits new use of the photograph during this period.
Publications or products already produced and distributed during the licensed period do not need to be withdrawn when the licence expires.
If a publication is intended to remain actively produced, substantially republished or commercially relaunched after the five-year period, a further licence may be required.
6. Territory
The Standard Image Licence is worldwide.
The purchaser may distribute the licensed publication or release internationally.
Additional licensing may be required where the scale, nature or duration of distribution is substantially beyond the normal scope of the Standard Image Licence.
7. Print runs and substantial distribution
The Standard Image Licence is intended for ordinary independent and commercial publishing.
Where a publication has a print run exceeding 5,000 copies, or where the intended distribution is unusually large, please contact Will Arden Photography before purchase.
Additional licensing fees may apply to:
very large print runs;
multiple editions;
substantial international distribution;
multiple-language publishing programmes; or
other unusually extensive uses.
8. Album and music artwork
The Standard Image Licence permits use of the photograph as artwork for one album, single, EP or equivalent musical release.
This includes the ordinary digital artwork associated with that release and reasonable promotional use directly connected with it.
The licence does not automatically include:
tour merchandise;
T-shirts;
posters for resale;
physical products incorporating the image;
advertising campaigns;
unrelated commercial products; or
packaging.
Those uses require a separate licence.
9. Editing and cropping
The purchaser may:
crop the photograph;
resize it;
adjust its resolution; and
make reasonable technical adjustments required for the licensed use.
The photograph must not be materially altered or manipulated in a manner that is misleading, defamatory, derogatory or damaging to the photographer or the integrity of the work.
Where significant manipulation is proposed, please contact Will Arden Photography before publication.
10. Uses NOT included
The Standard Image Licence does not permit:
paid advertising;
advertising campaigns;
billboards or large-scale outdoor advertising;
commercial advertising;
packaging;
merchandise;
products incorporating the photograph for resale;
posters or prints for resale;
calendars or similar products for resale;
use as a logo or trademark;
stock photography redistribution;
inclusion in another image library or stock library;
resale of the digital file;
sublicensing;
transfer of the image to another image library;
use by an unrelated third party;
use in unrelated commercial projects;
exclusive use;
artificial intelligence training;
machine-learning datasets;
generative AI model training;
creation of AI-generated derivative works based substantially on the photograph;
NFTs or comparable digital-token products; or
any unlawful use.
These uses may be available under a separate licence by agreement.
11. Advertising
Advertising is licensed separately because advertising can involve substantially greater commercial exposure and value.
Advertising includes, but is not limited to:
paid social-media advertising;
online advertising;
search advertising;
display advertising;
printed advertising;
billboards;
outdoor advertising;
advertising campaigns;
corporate advertising; and
promotional campaigns for products or services.
Advertising licences are available from £250, depending on the proposed use.
The final fee may depend on:
territory;
duration;
media;
campaign size;
audience;
print quantity;
exclusivity; and
other relevant factors.
Please contact Will Arden Photography before using an image for advertising.
12. Packaging
Use of an image on packaging is not included in the Standard Image Licence.
Packaging licences are available from £300, subject to the product, quantity, territory, duration and intended distribution.
Large or ongoing packaging programmes may require a separately negotiated licence.
13. Merchandise and products for resale
The Standard Image Licence does not permit use of a photograph on products manufactured or sold for commercial gain.
This includes, for example:
T-shirts;
posters;
prints;
mugs;
calendars;
greetings cards;
home décor;
stationery; and
other merchandise.
Merchandising licences are available from £300, subject to the proposed use.
Large-scale or ongoing merchandise programmes may be priced separately.
14. Exclusive rights
All Standard Image Licences are non-exclusive.
This means that Will Arden Photography may continue to license the same photograph to other customers.
Exclusive rights are available by quotation.
The price of an exclusive licence will depend on:
the territory;
duration;
market;
intended use;
level of exclusivity; and
any restrictions placed on future licensing.
15. Film, television and broadcast
Film, television, streaming productions and other broadcast uses are not automatically included in the Standard Image Licence.
Please contact Will Arden Photography for a quotation.
16. Transfer and sublicensing
The licence is granted to the purchaser or organisation identified at the time of purchase.
The licence may not be:
sold;
transferred;
sublicensed;
assigned; or
granted to another organisation
without written permission.
Where an image is purchased on behalf of a client, the licence should identify the relevant client or project.
17. Digital file
The purchaser receives a digital file for the licensed use.
The purchaser may store the file securely for the purposes of the licensed project.
The original high-resolution file must not be:
resold;
publicly redistributed;
uploaded to a stock library;
made available for unrestricted download; or
supplied to another party for unrelated use.
The purchaser should take reasonable steps to prevent unauthorised access to the original file.
18. Attribution
Where the format reasonably permits, the photographer should be credited as:
© Will Arden Photography
Where a publication has specific credit requirements, please contact Will Arden Photography.
19. Model, property and third-party rights
Unless expressly stated otherwise, Will Arden Photography does not guarantee that a photograph includes model releases, property releases, trademark clearances or other third-party permissions.
The purchaser is responsible for determining whether additional permissions are required for the intended use.
Where a proposed use involves identifiable people, private property, trademarks, artworks or other third-party rights, the purchaser should obtain any additional permissions required.
20. Unauthorised use
Any use outside the licence granted by these Terms & Conditions requires prior written permission.
If an image is used outside the scope of the purchased licence, Will Arden Photography reserves the right to seek an appropriate additional licence fee and any other remedies available under applicable law.
Purchasing an image does not retrospectively authorise an unauthorised use.
21. Multiple uses
The Standard Image Licence applies to the specific project or publication for which it was purchased.
If the same photograph is subsequently required for another:
book;
magazine;
album;
publication;
advertising campaign;
product;
merchandise programme; or
commercial project,
a separate licence may be required.
If you are unsure whether a proposed use is covered, please contact Will Arden Photography before using the image.
22. Payment and digital supply
Payment must be received before the licensed digital file is supplied.
Following successful payment, the purchaser will normally receive a digital download link.
Download links may be subject to technical expiry periods imposed by the website platform.
The purchaser may retain the downloaded file for the purposes of the licensed project.
23. Digital content and cancellation
The images supplied through the Image Library are digital content.
Where applicable under UK consumer law, the purchaser will be asked at checkout to expressly request immediate supply of the digital content and acknowledge the effect this may have on the statutory right to cancel once supply has begun.
Nothing in these Terms & Conditions is intended to remove or restrict any statutory consumer rights that cannot lawfully be excluded or restricted.
24. Refunds
Because the product is digital content, purchases are generally non-returnable once the digital content has been supplied.
If a supplied file is corrupted, materially defective or cannot reasonably be downloaded because of a technical fault attributable to Will Arden Photography, please contact us.
We will normally attempt to provide a replacement file or corrected download.
If the problem cannot reasonably be resolved, a refund may be considered.
This does not affect statutory rights that cannot lawfully be excluded.
25. Licence acceptance
By purchasing an image, the purchaser confirms that they:
have read and accepted these Image Licence Terms & Conditions;
understand the permitted and excluded uses;
have selected the licence appropriate to their intended use;
understand that the purchase does not transfer copyright; and
agree to comply with the restrictions applying to the licensed image.
26. Changes to licensing terms
Will Arden Photography may update these Terms & Conditions from time to time.
The Terms & Conditions applicable to a particular purchase will be those presented to the purchaser at the time of purchase.
Changes to these Terms & Conditions will not retrospectively alter a licence already granted unless required by law or agreed with the purchaser.
27. Governing law
These Terms & Conditions are governed by the laws of England and Wales.
Nothing in these Terms & Conditions is intended to remove or restrict any statutory rights which cannot lawfully be excluded or restricted.
